1. NATURE OF THE PROGRAM
1.1 NOT INSURANCE. FALTAH COVER™ IS AN OPTIONAL CONTRACTUAL SERVICE GUARANTEE OFFERED DIRECTLY BY FALTAH US, INC., A WYOMING CORPORATION ("FALTAH"), TO SENDERS WHO PURCHASE IT FOR A DELIVERY. FALTAH COVER IS NOT AN INSURANCE POLICY, A CONTRACT OF INSURANCE, A WARRANTY OF CARRIAGE, OR A SURETY BOND. FALTAH IS NOT AN INSURANCE COMPANY, UNDERWRITER, OR INSURANCE PRODUCER, AND FALTAH COVER IS NOT PROTECTED BY ANY STATE INSURANCE GUARANTY FUND.
1.2 Relationship to the Terms. This Policy forms part of the Faltah Terms of Service (the "Terms"). Capitalized terms not defined here have the meanings given in the Terms. If this Policy and the Terms conflict on a Faltah Cover question, this Policy controls.
1.3 Optional. Faltah Cover is never added by default. You choose it at checkout for a specific Delivery, by declaring the Parcel's value. Without Faltah Cover, Section 16 of the Terms (Limitation of Liability) applies in full.
2. PRICE AND COVERAGE LIMITS
2.1 Protection fee. The fee is 2% of the declared value, with a minimum of US $1.50 and a maximum of US $10.00 per Delivery (aligning with the US $500 maximum coverage limit). It is shown before you pay and is non-refundable once the Driver confirms pickup.
2.2 Maximum coverage. The most Faltah will reimburse for any one Delivery is the lowest of:
(a) the declared value you entered at booking;
(b) the Parcel's actual cash value at the time of loss, meaning its replacement cost less depreciation, as shown by the documents in Section 4; and
(c) US $500.
2.3 Deductible. There is no deductible ($0 deductible) on approved Faltah Cover claims.
2.4 Partial damage. For a Parcel that is damaged but not destroyed, Faltah will reimburse the lower of the reasonable cost of repair and the amount in Section 2.2.
2.5 Delivery Fee. If a claim for total loss is approved, Faltah will also refund the Delivery Fee for that Delivery.
3. WHAT IS COVERED
Faltah Cover reimburses direct physical loss of, or damage to, a covered Parcel that occurs after the Driver confirms pickup in the app and before Proof of Delivery, subject to the conditions in Section 4 and the exclusions in Section 5.
4. CONDITIONS FOR A CLAIM
To be eligible for reimbursement, all of the following must be true:
(a) Cover purchased. Faltah Cover was selected and paid for at booking, before pickup.
(b) Photos before pickup. The Sender's photo of the Parcel and its packaging was uploaded at booking, and the Driver's pickup photo was recorded in the app.
(c) Timely claim. The claim is submitted through the in-app dispute process within 7 calendar days after the scheduled delivery date.
(d) Proof of value. The Sender provides proof of ownership and of the original purchase value, such as a merchant invoice, receipt, or bank statement. For an item without a receipt, Faltah may accept other reasonable evidence of value at its discretion.
(e) Damage evidence. For damage, the Sender provides photos of the damaged item and packaging taken within 48 hours after delivery, and keeps the item and packaging available for inspection for 30 days.
(f) Police report for theft. For a Parcel the Sender believes was stolen, the Sender provides a police report filed within 7 days after the Sender learns of the loss, with the report number.
(g) Truthful declaration. The Parcel matched its description, contained no Prohibited Item, and was packed as required by Section 5 of the Terms.
(h) Cooperation. The Sender cooperates with Faltah's investigation, including by answering reasonable questions and providing documents.
5. EXCLUSIONS
FALTAH COVER DOES NOT APPLY TO ANY OF THE FOLLOWING:
(a) Prohibited Items (Section 8 of the Terms), and any Parcel that was refused, seized, or surrendered under Section 7 of the Terms;
(b) Fragile items not properly protected, including glass, ceramics, artwork, and musical instruments, unless they were cushioned and packed in a rigid outer container suitable for road transport;
(c) Electronics shipped without their original manufacturer packaging or equivalent protective packaging, and any loss of data or software;
(d) Cash and valuables, including currency, gift cards, negotiable instruments, precious metals, loose gemstones, and jewelry;
(e) Perishables, including food, plants, and anything requiring temperature control, and any deterioration, spoilage, or mold;
(f) Concealed damage, meaning damage inside packaging that was undamaged at delivery, unless the Driver's pickup photo shows the contents were undamaged;
(g) Wear and tear and inherent defects, including normal wear, mechanical or electrical breakdown, and gradual deterioration;
(h) Poor packing or misdeclaration by the Sender, including understated weight or misdescribed contents;
(i) Delay, and any indirect or consequential loss such as lost profits, missed deadlines, or loss of use;
(j) Events after Proof of Delivery, including Parcels left at a location the Sender chose for contactless drop-off;
(k) Fraud or dishonesty by the Sender, the Recipient, or anyone acting for them; and
(l) Force majeure, meaning natural disasters, severe weather, fire, flood, earthquake, epidemic, war, terrorism, riot, civil unrest, government action, confiscation by any authority, and nuclear or radioactive contamination.
6. CLAIM DECISIONS AND PAYMENT
6.1 Timing. Faltah will acknowledge a complete claim within 5 business days and decide it within 30 days, or tell you why more time is needed.
6.2 Discretion. Faltah decides claims in good faith and at its reasonable discretion, based on the Delivery records, photos, and documents provided.
6.3 Payment. Approved amounts are paid to the Sender's original payment method, or by another method Faltah chooses.
6.4 Subrogation. By accepting payment, the Sender assigns to Faltah its rights against any person responsible for the loss, up to the amount paid, including any Driver at fault, and will cooperate in their recovery.
6.5 Sole remedy. WHERE FALTAH COVER APPLIES, IT IS THE SENDER'S SOLE AND EXCLUSIVE REMEDY AGAINST FALTAH FOR LOSS OF OR DAMAGE TO THE PARCEL. It does not limit any claim the Sender has against a Driver directly, except to the extent the Sender has been reimbursed.
6.6 Fraud. A false or exaggerated claim voids Faltah Cover for that Delivery and may lead to the closure of the account and a referral to law enforcement.
7. DISPUTES
A Sender who disagrees with a claim decision may ask for it to be reviewed by replying within 30 days. After that, any dispute is resolved under Section 17 (Binding Arbitration) and Section 18 (Governing Law) of the Terms.
8. CHANGES
Faltah may change this Policy for future Deliveries. The version in effect when you buy Faltah Cover applies to that Delivery.
